These Terms and Conditions govern purchases from and use of the online shop operated by Jon Carling at joncarling.bigcartel.com.

By accessing the shop, placing an order, or purchasing a product, you agree to these Terms and Conditions, together with the shop’s Privacy Policy, Shipping and Delivery Policy, and Returns and Refunds Policy.

Please review these policies before placing an order.

1. Shop operator

The shop is hosted through Big Cartel. Checkout and payment services may be provided by third-party payment processors.

2. Eligibility to purchase

You must be legally capable of entering into a binding purchase agreement to place an order.

Customers under the age of majority in their location should place orders only with the involvement and authorization of a parent or legal guardian.

By placing an order, you confirm that:

• The information you provide is accurate and complete.
• You are authorized to use the selected payment method.
• You are purchasing for a lawful purpose.
• You have reviewed the relevant product description and shop policies.

3. Products and availability

The shop may offer products including:

• Original artwork
• Prints and paper goods
• Books and zines
• Apparel
• Figurines and collectibles
• Limited-edition merchandise
• Preorders
• Commissioned or made-to-order work
• Other art-related products

Products are subject to availability.

Adding an item to a cart does not reserve it. An order is not complete until payment has been successfully processed and the order has been accepted.

Because original artwork and limited-edition items may be unique or available in small quantities, an item may become unavailable before checkout is completed.

4. Product descriptions and images

Reasonable efforts are made to describe and photograph products accurately.

Product listings may include information such as:

• Dimensions
• Materials
• Edition size
• Condition
• Whether an item is an original or reproduction
• Whether framing is included
• Processing or preorder schedules
• Variations inherent in handmade production

Measurements described as approximate may vary slightly.

The color and appearance of artwork or merchandise may differ somewhat from on-screen images because of monitor settings, lighting, photography, printing methods, materials, and normal production variations.

Minor variations that are inherent in handmade, hand-finished, individually printed, or independently manufactured products are not necessarily defects.

Any complimentary extras included with an order are provided at Jon Carling’s discretion, may vary, and are not part of the purchased product unless specifically identified as included in the product description.

5. Prices and payment

Prices are displayed in the currency indicated by the shop and may be changed at any time before an order is placed.

The price charged is the price shown at checkout when the order is submitted, together with any applicable:

• Shipping charges
• Sales tax
• Import-related charges collected at checkout
• Other clearly disclosed charges

Payment must be completed through one of the payment methods offered at checkout.

Payment processing is handled by third-party providers such as Stripe or PayPal. Jon Carling does not directly receive or store complete payment-card numbers.

Customers are responsible for charges imposed by their bank, card issuer, payment provider, customs authority, or foreign-currency conversion service.

6. Order acceptance and cancellation

An automated order confirmation acknowledges receipt of an order but does not necessarily constitute final acceptance.

Jon Carling may refuse or cancel an order before shipment for legitimate reasons, including:

• Payment failure
• Suspected fraud or unauthorized payment
• Incorrect pricing or listing errors
• Inventory errors
• Shipping restrictions
• An incomplete or invalid address
• Suspected resale, abuse, or unlawful activity
• Inability to fulfill the order
• A technical malfunction affecting the transaction

If an order is canceled after payment has been collected, the amount paid for the canceled portion will be refunded through the original payment method.

Customers should contact contact@joncarling.com promptly to request an order cancellation. Cancellation cannot be guaranteed once processing, production, personalization, packaging, or shipment has begun.

7. Shipping and delivery

Processing periods, delivery estimates, international shipping, tracking, delayed shipments, lost packages, damaged shipments, and address errors are governed by the separate Shipping and Delivery Policy.

Most standard orders are processed within the period stated in that policy. Preorders, commissions, made-to-order products, and special releases may have different schedules stated in their product descriptions.

Delivery dates are estimates unless expressly guaranteed in writing.

If an order cannot be shipped within the stated or otherwise applicable timeframe, the customer will be offered the opportunity to accept a revised shipping date or cancel the affected order for a refund.

Customers are responsible for providing a complete and accurate delivery address and for reviewing shipping restrictions that apply to their destination.

8. International orders

International customers are responsible for complying with the laws and import requirements of their destination country.

Unless expressly collected at checkout, the customer is responsible for:

• Customs duties
• Import taxes
• Value-added taxes
• Brokerage charges
• Handling fees
• Other charges imposed by authorities or delivery services

Jon Carling does not control customs inspections, import decisions, fees, or processing times.

An order returned because the customer refused delivery, failed to pay import charges, or provided an undeliverable address may be subject to deductions for nonrecoverable shipping, return, customs, or handling expenses, except where prohibited by law.

9. Returns and refunds

Returns, exchanges, cancellations, damaged products, incorrect orders, lost shipments, preorders, and commissioned work are governed by the separate Returns and Refunds Policy.

Except for the circumstances described in that policy or rights that cannot legally be waived, all sales are final.

Customers should not return an item without first contacting contact@joncarling.com and receiving instructions.

10. Preorders

A preorder is a purchase of a product that is not ready to ship when the order is placed.

Estimated production or shipping dates will be included in the relevant product description when available. These estimates may change because of production, manufacturing, supply, quality-control, customs, or carrier delays.

When a material delay occurs, customers will be notified and provided with any cancellation or refund option required by applicable law.

Products ordered together with a preorder may be held until the preorder is ready unless separate shipment is arranged.

11. Commissions and made-to-order work

Commissioned, customized, personalized, and made-to-order work may be governed by a separate written agreement.

That agreement may establish:

• Scope
• Price and payment schedule
• Deposit
• Production schedule
• Revision limits
• Approval process
• Delivery format
• Shipping
• Cancellation terms
• Copyright and licensing rights

Where a separate signed or expressly accepted commission agreement conflicts with these general Terms, the specific commission agreement controls for that project.

Unless otherwise stated in writing, submitting an inquiry does not create a client relationship or require Jon Carling to accept a commission.

Payments or deposits may become nonrefundable after work begins, materials are purchased, or production is ordered, as stated in the applicable agreement or product listing.

12. Original artwork and physical ownership

Purchasing an original artwork transfers ownership of the physical artwork only.

It does not transfer copyright or grant reproduction, publication, adaptation, merchandising, licensing, promotional, digital, artificial-intelligence-training, or other intellectual-property rights.

The owner of the physical artwork may display or resell that physical object, subject to applicable law, but may not commercially reproduce or license the artwork without prior written authorization.

13. Copyright and intellectual property

Unless otherwise identified, the original artwork, illustrations, characters, product photographs, written descriptions, graphics, shop design elements created by Jon Carling, and other original content are protected by copyright and other applicable intellectual-property laws.

All copyright and reproduction rights remain with Jon Carling or the identified rights holder.

Without prior written permission, you may not:

• Reproduce or republish artwork or shop content
• Create or sell prints, merchandise, digital products, or adaptations
• Use artwork in a logo, advertisement, publication, product, film, game, website, or commercial project
• Remove or obscure copyright notices
• Present the work as your own
• Scrape, archive, or systematically download shop images or text
• Use shop content to train, develop, test, or improve an artificial-intelligence or machine-learning system
• Mint, tokenize, or sell the work as an NFT or comparable digital asset

Ordinary personal viewing and sharing a direct link to a public product page are permitted.

14. Third-party rights

Some portfolio images, collaborative work, licensed products, project titles, trademarks, characters, or other materials may belong to clients, publishers, collaborators, manufacturers, or other rights holders.

Those materials remain the property of their respective owners and may not be used without authorization from the appropriate rights holder.

Nothing in the shop grants a license to use any third-party name, trademark, artwork, character, or other protected material.

15. Figurines and collectible products

Unless a product listing expressly states otherwise, figurines and similar products are sold as decorative collectibles and are not intended as children’s toys.

Product listings may contain specific age, material, fragility, small-part, or handling information. Customers are responsible for reviewing those notices before purchase and keeping collectibles away from children or pets when appropriate.

No product should be used for a purpose inconsistent with its description or warnings.

16. Gift cards

When gift cards are offered, they are redeemable only through this online shop unless otherwise stated.

Gift cards:

• Have no value outside the shop
• Cannot be used to purchase another gift card unless expressly permitted
• Should be protected like cash
• May not be replaced if lost, stolen, or used without authorization unless the code can be verified and legally disabled
• Are subject to any rights and restrictions required by applicable law

Gift-card expiration, fees, refunds, and cash redemption will be handled in accordance with applicable law.

If a purchase exceeds the gift-card balance, the remaining amount must be paid using another accepted payment method.

17. Promotions and discount codes

Promotions, sales, and discount codes may be subject to additional terms stated when offered.

Unless otherwise stated:

• Discounts cannot be combined.
• Discounts have no cash value.
• A discount applies only during its advertised period.
• A discount cannot be applied retroactively to a completed order.
• Promotions may exclude original artwork, commissions, preorders, gift cards, shipping, taxes, or specified products.
• A promotion may be modified or withdrawn before an eligible order is completed.

18. Prohibited conduct

You may not use the shop to:

• Commit fraud or make an unauthorized purchase
• Submit false information
• Interfere with the shop’s operation or security
• Introduce malicious software or code
• Attempt to gain unauthorized access to accounts or systems
• Scrape, harvest, or systematically collect shop information
• Misuse the contact form
• Violate intellectual-property rights
• Resell products using misleading claims about affiliation or authorization
• Engage in unlawful, abusive, threatening, or harassing conduct

Access or service may be limited or refused when reasonably necessary to protect the shop, its customers, or others.

19. Privacy

Personal information is handled as described in the separate Privacy Policy.

By using third-party payment, shipping, or platform services, customers may also be subject to those providers’ privacy policies and terms.

20. Third-party services and links

The shop relies on or may link to services operated by third parties, including:

• Big Cartel
• Payment processors
• Shipping and delivery companies
• Social-media services
• The main Jon Carling website
• Other external services

Jon Carling does not control and is not responsible for the independent content, availability, security, privacy practices, or terms of those services.

Use of a third-party service is subject to that provider’s own policies.

21. Shop availability and errors

Reasonable efforts are made to keep the shop available and accurate, but uninterrupted or error-free operation is not guaranteed.

The shop may occasionally be unavailable because of:

• Maintenance
• Platform outages
• Internet or hosting failures
• Payment-service interruptions
• Security concerns
• Technical errors
• Events outside reasonable control

Obvious typographical, pricing, inventory, or technical errors may be corrected. When an error materially affects an order, the customer will be contacted and may be offered a corrected transaction or cancellation and refund.

22. Disclaimer of warranties

To the extent permitted by law, the shop and its content are provided on an “as available” basis.

No warranty is made that:

• The shop will always be available or error-free
• Product photographs will appear identically on every device
• Delivery estimates will be unaffected by third parties or external events
• Shop content will meet every visitor’s particular purpose

This section does not exclude express product commitments or consumer rights that cannot legally be waived.

23. Limitation of liability

To the extent permitted by applicable law, Jon Carling will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the shop, delayed delivery, third-party services, or unauthorized use of products or content.

Where liability cannot legally be excluded, Jon Carling’s liability will be limited only to the extent permitted by law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including applicable liability for fraud, intentional misconduct, or legally protected consumer remedies.

24. Indemnification

To the extent permitted by law, you agree to be responsible for losses, claims, or expenses resulting from your unlawful misuse of the shop, infringement of another person’s rights, fraudulent conduct, or material violation of these Terms.

This section does not require a consumer to indemnify Jon Carling for Jon Carling’s own unlawful conduct or obligations that cannot legally be shifted.

25. Governing law

These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles.

Nothing in these Terms deprives a consumer of mandatory protections provided by the law of the consumer’s jurisdiction when those protections apply and cannot legally be waived.

Before filing a formal dispute, customers are encouraged to contact contact@joncarling.com so that the matter can be reviewed and an informal resolution attempted.

26. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue in effect.

27. No waiver

A failure to enforce any provision of these Terms does not waive the right to enforce that provision later.

Any waiver must be clear and applies only to the particular circumstances in which it is given.

28. Changes to these Terms

These Terms may be updated to reflect changes in the shop, products, services, business practices, or legal requirements.

The revised version will be posted with a new effective or last-updated date.

Changes will apply prospectively and will not alter a completed purchase retroactively unless required by law or agreed with the customer.
